TERMS & CONDITIONS

ACCEPTANCE OF THIS AGREEMENT 

Throughout this agreement, the words ‘we’, ‘us’ and ‘our’ refer to Vacation Card Services, the supplier offering credit card services.  The words ‘you’, ‘your’ and ‘yours’ refer to all persons responsible for complying with these terms and conditions, including the person who applied to register with us to use these services.  The words ‘they, ‘them’ and their’ refer to the third party whose credit card details are being used to take payment.

 

Vacation Card Services is only a Payment Service Provider.  We help you accept payments from third parties.  We are an independent contractor for all purposes, except that we act as your agent only with respect to the custody of your funds.  We do not have control of or liability for the products or services that are paid for with our Service.  We do not guarantee the identity of any User or ensure that a buyer or a seller will complete a transaction.

 

To be eligible for our Services, you must be at least 21 years old and you must be the legal owner of a Vacation Home.

 

You authorize us to make any inquiries we consider necessary to validate your identity, which also may require you to prove ownership of your vacation home.

 

You agree to defend, indemnify and hold us harmless from any claim or demand (including attorneys’ fees) made or incurred by any third party due to or arising out of your breach of this Agreement and/or your use of the Services. 

USING YOUR ACCOUNT 

  1. You agree to supply us with the following:
    1. your full name
    2. address of permanent residence
    3. telephone number
    4. email address
    5. vacation home address
    6. current credit card number, expiry date, CVC code, name as printed on the card if different from the above and billing address
    7. US Bank Name, address, telephone number, account number, routing number

 

  1. There are two types of transactions that can be processed, they are:

    Payments (these can consist of deposits, final balances, full payment & security deposits) – this type of transaction is taken immediately from the credit card details supplied.

    Authorisation** (this type of payment is normally used for security deposits) – this type of transaction is not taken from the credit card details supplied but simply held against the card should the need arise to charge this amount (this should be fully explained to the cardholder and under what circumstances they are likely to have this amount taken). 

     

    ** To be able to use our authorisation facility homeowners must have used our credit card facility for the original payment.

     

 

  1. You agree and will comply with that we only take Visa and MasterCard transactions.

 

  1. You agree to inform foreign cardholders (those other than US residents), that their credit card company/banking institution is aware that a US$ transaction is going to take place against their credit card so as to avoid a decline which incurs a charge to you.

 

  1. Should a credit card transaction be declined, whether due to an error in the information supplied by you or problems associated with the cardholder, then you agree to pay the declined charge using the credit card information you supplied at registration.  We reserve the right to take further steps to recover funds owed.

 

  1. In the event of a chargeback, we will determine whether we should dispute the chargeback with the credit card company.  If we dispute the chargeback, we will place a temporary hold on any funds currently owed to you, whether associated with the disputed funds or not, until the credit card company makes a decision.  The credit card company, not us, will determine who wins the chargeback.  You agree that we will NOT assume all risk should the third party initiate a chargeback for whatever reason, you will be responsible for this and we will make an additional charge for the amount of time that is involved in forwarding necessary evidence to the Merchant Services on your behalf.  We reserve the right to take further steps to recover funds owed by you. 

 

  1. It is your responsibility to pay the Florida Department of Revenue and relevant Tourist Tax Departments, the tax due on the full amount paid by the third party on your tax return slips and not the amount once credit card charges have been deducted.

 

  1. Under US law you are not allowed to charge the third party an additional fee for card processing.

 

PAYMENTS 

You agree to the following rates and fees:  

Initial Set up fee

$25 + $5 transaction fee

Vacation Card Services Rate and processing fee

3.5% + $5 per transaction

Declined Payment Fee

$25 + $5 transaction fee

Chargeback Fee

$35 + $5 transaction fee

Grace period for payment of transactions

This will be paid on the 7th day following the transaction plus any banking transfer time; this may vary depending on each financial institution.

Minimum per transaction amount

$50

Maximum per transaction amount

$5,000

 

FINALLY

1.     Completion of the Agreement constitutes acceptance of a contract on these terms. 

2.     We reserve the right to terminate this Agreement at any time upon notice to you.

3.     We reserve the right to change the terms of this agreement (including rates) at any time, for any reason.
